It's the same as plan A, but this time you send more money to pay for more signatures to be disqualified before the whole thing is tossed back in your face. Feeling demoralized yet? No? Yesterday afternoon, Justice Edward Lehner of the State Supreme Court rubberstamped Referee Louis Crespo’s recommendation that the decision to establish a local commission to investigate the events of September 11th not be put before the voters on November 3rd.
After showing interest in weighing both sides’ arguments in the hearing, the Judge’s short decision gives no indication of having considered the arguments put forth in the Petitioners’ memorandum of law, nor any acknowledgement of the need for a new investigation, which the City of New York callously dismissed as “irrelevant”.
On a dark day for democracy, the patriotic call for answers by hundreds of 9/11 families, first responders and survivors has been stifled, and the will of the people of New York City once again denied.
Judge Lehner ruled that modifying the petition to make it “legally permissible” would result in it being “inconsistent with the law sought by the signatories of the Petition” despite the fact that all 80,000 signatories agreed by signing the Petition that “If any provision of this law is held to be unconstitutional or invalid for any reason, the remaining provisions shall be in no manner affected thereby but shall remain in full force and effect.”
The deadline for inclusion on the ballot falls just before the election, making it possible to appeal Judge Lehner’s decision. NYC CAN is weighing all options and will make an announcement early next week on this issue, as well as on how it will be moving forward on other fronts. Regardless of the outcome in court, the quest for answers continues full throttle. This fight is only the beginning.

If all that effort that went into gathering the signatures had been put into a more modest proposal, then SOME kind of 9/11 related ballot question could have appeared on the ballot already. But since someone had the brilliant idea to demand all kinds of ridiculous powers all that effort was easily shot down. Suckers. The fake truthers and LIHOPpers must get such a kick out of raising people's hopes knowing they will be dashed!

yes, i would agree from an insider's perspetive that. . .
. . . the proposal should have been MUCH more modest, drawn say to simply investigate the collapse of building 7. this came out during the hearing and indeed, the "building what?" campaign grew out of the failed nyccan effort.
back in 2009, i became involved as pro bono attorney of record in the nyccan action challenging the clerk's findings that (a) there were not enough signatures (we beat that one), and that (b) the petition was legally flawed (we lost that one).
all of the nyccan people i met back then struck me as "genuine truthers." but, what became apparent to us way too late in the game was that the petition had not been effectively vetted initially, and there was an ASSumption all along that it had been. so while i agree with much of your criticism of the nyccan effort, i would take exception to the "fake truther" charge. i think it was more a case of not knowing what the fuck we were doing, while desperately trying to "do something" about 9/11. did that make us "fakes truthers?" i submit not.
as for lihop vs mihop, i didn't even grasp this distinction and the significance of it till very recently, well after the nyccan effort was over and done. suffice it to say, i (and i think many others in the nyccan effort back in 2009) lacked your insight and sophistication.
Unfortunate but not wholely unforseeable...
How could anyone honestly expect this effort would have succeeded? We don't actually live in a democracy anymore, you know and the ONE THING that is most important to the imperialist agenda supported by the entire Washington Concensus, is the Global War on Terror.
So how could anyone rationally expect this effort to have produced a positive result.
Of course we know the Globalists missed a golden opportunity. Their electronic voting system could have easily crushed the iniciative once it was on the ballot and then they could have used THAT result to further marginalize the Truth advocates' efforts in the future. But by striking it down now they opted for the "it doesn't even merit consideration" approach.
Of course, 80,000 signatures is an impressive feat, but when you consider that New York has over 8.3 million people, it is hard to argue that the 0.95% of the population's wishes really amount to some kind of huge ground-swell.
I think this was just an opportunity to LOOK "AS IF" good work were being done... and I would be curious to see the books they kept as far as accounting of all the donations are concerned.
