Lawyers for the family of a Sept. 11 victim can question a United Airlines employee about a call allegedly made using her cell phone to terrorist ringleader Mohammed Atta, a judge has ruled.
Manhattan federal Judge Alvin Hellerstein gave the lawyers up to an hour to ask Julie Ashley about "any communications she may have had, or has first-hand knowledge of, in which information about United Airlines' operations was communicated to one of the Sept. 11 hijackers."
But Hellerstein barred any questions during the pretrial deposition about Ashley's husband, Iranian-born pilot Ahmad Farid Khorrami, who was jailed for three months on mistaken suspicion of links to some of the hijackers.
Hellerstein also held off deciding whether Ashley can be called as a witness at the upcoming trial over the death of former Los Angeles Kings hockey scout Mark Bavis, who was killed when United Flight 175 crashed into the south tower of the World Trade Center.
Ashley has denied any contact with the terrorists, and United says she "has no relevant testimony to provide" regarding the wrongful-death suit filed against it by Bavis' mother, Mary, who has accused the airline of negligence.
